On 15 March 2019 by Government Gazette No. 6558, Government Notice No. 59 of 2019, His Excellency Dr Hage Gottfried Geingob, President of the Republic of Namibia, in terms of section 1 of the Commissions Act, 1947 (Act No.8 of 1947) appointed the Commission of Inquiry into Claims of Ancestral Land Rights and Restitution (the Commission). The main purpose for which the Commission was appointed was "To inquire into and report generally on the claims of ancestral land rights and restitution to groups and individuals". Apart from this general term of reference, the Commission was also given specific terms of reference as gazetted, which are discussed in Chapter 1 of this Report. It is a fact that Namibia was subjected to colonial rule for a period of 106 years namely, from 1884 to 1990. The legacy of more than a century of colonialism bequeathed to an independent Republic of Namibia many challenges, of which the skewed land distribution that was in favour of a white minority, has dominated the post - independence land, public and policy discourses. The geographical area of Namibia is approximately 82.4 million hectares of land.2 There are three primary forms of land ownership in Namibia namely, freehold commercial land, non-freehold communal land and state land.
